The Court denied Plaintiffs' motions to certify multi-state classes and set a deadline for Plaintiffs to seek certification of a class consisting of Missouri consumers. (Document Number 754)

The Court entered final approval to a settlement with respect to Philips Electronics. The order has been appealed to the Eighth Circuit Court of Appeals. (Document Number 695)
January 22, 2009
Following a telephone conference held earlier in the day, the Court ordered Defendants to file motions requesting Plaintiffs file statements of claims by January 28, 2009.
November 25, 2008
The Court issued its initial Case Management Order. Among other things, the order set a deadline of March 1, 2009, for the Defendants to file motions to dismiss the case and to submit proposals regarding mediation. The Court also approved the organizational structure for the attorneys representing the Plaintiffs.
November 9, 2009
In three separate orders, Judge Smith dismissed all of the Formula Defendants and certain claims against the Bottle Defendants, including claims of fraudulent misrepresentation. He also ordered the parties to submit proposed dates for completion of discovery, filing of motions for class certification, and other motions.
