Mediation and Assessment Program (MAP)

The Mediation and Assessment Program (MAP) (previously known as the Early Assessment Program or EAP) is the Western District of Missouri’s alternative dispute resolution program for civil lawsuits.

All non-excluded civil cases filed in the Western District that are included in the MAP are randomly assigned to one of three categories for mediation: 1) a United States Magistrate or a United States Bankruptcy Judge; 2) the MAP Director; or 3) the Outside Mediator category. The parties are required to mediate cases assigned to MAP within 75 days of the Rule 26(f) meeting required under the Federal Rules of Civil Procedure. When a case is filed, a Notice of Inclusion in the MAP is issued in the case and the party initiating the lawsuit is required to serve the Notice of Inclusion on all other parties in the case. The Notice of Inclusion indicates which of the three categories the case is assigned to for mediation.

If your case is assigned to the Outside Mediator category, you are required to file a Designation of Mediator certificate (ADR event in ECF) within 14 days of your Rule 26(f) meeting, identifying your jointly selected mediator and the date, time and location of the in-person mediation (to occur within 75 days of your Rule 26(f) meeting). Many mediators book up months in advance so you will need to promptly contact your chosen mediator. If a mediator is not available to accommodate your mediation deadline, you will need to select another mediator with availability to match your deadline.

If you are assigned to a Judge or the MAP Director for mediation, you will receive notice of the mediation date from his or her respective office.

Please review and strictly comply with the MAP General Order, which contains pertinent information including but not limited to in-person mediation attendance requirements for parties, party representatives, applicable insurance representatives and lead trial counsel and deadlines for filing Designation of Mediator certificates, completing mediation and post-mediation status reports.
