NOTICE RE: AMENDMENTS TO LOCAL RULES AND CM/ECF ELECTRONIC CASE FILING PROCEDURES

The following amendments to Local Rules and Procedures of the United States Bankruptcy Court, Western District of Missouri, will take effect on April 1, 2005:

  • Local Rule 2016-1, Compensation of Professionals: The fee allowable for counsel in a case without itemized application will be raised to $2000 from $1500.
  • Local Rule 5010-1, Reopening Cases: A party seeking to file an adversary case to determine dischargeability of a debt in a closed bankruptcy case must first file a motion to reopen the closed main case. The filing fee may be waived if the dischargeability involves issues other than those under Section 523(c) of the Bankruptcy Code.
  • CM/ECF Administrative Procedures: Section II D is amended to delete the requirement for using /S/ to denote an electronic signature. Use of an authorized login and password to file documents electronically shall be sufficient to serve as an allowed electronic signature.
  • CM/ECF Administrative Procedures, Section II D: New subsection added to note that the original of any electronically filed petition, schedule, or document containing an original signature or verification shall be maintained by the filing attorney or party for a period of not less than two years after the case is closed.

A copy of the revised Administrative Procedures and the Court Orders amending the specified rules are posted to the Court’s Webssite.

These changes are being made pending subsequent revision of the Court’s Local Rules and will remain in effect until that time or until further order of the Court.
